Terms of Service

Last updated September 9, 2026. This is a plain-language agreement, not legal advice. My Usuals is operated by an individual sole proprietor (“My Usuals,” “we,” “us”). By using this site or claiming a spot you agree to these terms.

1. Acceptance

By accessing the site, claiming a founding spot, or using the service, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the service.

2. The service

My Usuals gives a local business a digital punch card — customers scan a counter QR code on each visit to check in and earn a reward the business configures — and automatically notices when a regular has gone quiet and sends that customer a personalized win-back text message with an optional discount offer. Features and descriptions may change as the product develops.

3. Eligibility

You must be at least 18 years old, located in the United States, and authorized to enter into this agreement on behalf of the business you represent.

4. Founding-member offer and billing

  • When you claim a founding spot, we save a payment card via Stripe and start a 30-day free trial. You are not charged during the trial.
  • If you do not cancel before the trial ends, your card is then charged $25 per month, automatically and on a recurring basis, until you cancel.
  • Your $25 founding rate is locked for as long as your subscription stays active, even after the standard price ($30 per month) applies to new customers. If you cancel and later re-subscribe, current standard pricing applies.
  • Prices are in US dollars and exclude any applicable taxes. Charges are handled by Stripe; by subscribing you also agree to Stripe's terms.

5. Cancellation and refunds

  • You can cancel at any time in one click from your dashboard, effective immediately. There is no phone call and no retention process. Cancellation stops future charges; it does not refund the current period except as stated below.

6. Your responsibilities as the sender

  • For messages sent to your customers, your business is the sender of record. You are responsible for having a lawful basis and valid consent to text each customer whose information you add.
  • You will not use the service to send content prohibited by mobile carriers or A2P 10DLC rules (including messages relating to illegal activity, hate, adult content, or unlawful financial or health claims).
  • You will honor opt-out requests and will not attempt to re-add a customer who has opted out.
  • You are responsible for keeping your account credentials secure and for activity under your account.

7. Acceptable use

You will not use the service for anything unlawful, abusive, infringing, deceptive, or high-risk; will not attempt to reverse engineer, disrupt, or gain unauthorized access to the service; and will not resell or sublicense it without our written permission.

8. Intellectual property

We own the platform, software, and branding. You keep ownership of your business and customer data, and you grant us the limited rights needed to operate the service for you.

9. Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind. Revenue-recovery figures, the loss calculator, and any projections are rough estimates for illustration only and are not guarantees of results.

10. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose.

11. Indemnification

You will indemnify and hold us harmless from claims, losses, and expenses arising out of your misuse of the service, your messages to your customers, or your breach of these terms.

12. Governing law

These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. The state and federal courts located in Florida will have exclusive jurisdiction over any dispute.

13. Changes to these terms

We may update these terms from time to time. The “last updated” date will change, and your continued use of the service after an update means you accept the revised terms.
